Assumption of the Risk and Waiver of Liability Relating to Coronavirus/COVID-19

The novel coronavirus, COVID-19, has been declared a worldwide pandemic by the World Health Organization. COVID-19 is extremely contagious and is believed to spread mainly from person-to-person contact. As a result, federal, provincial, and municipal governments and federal and state health agencies recommend social distancing and have, in many locations, prohibited the congregation of groups of people. Liberty Junction Theatre Inc. (“LJT”) has put in place preventative measures to reduce the spread of COVID-19; however, LJT cannot guarantee that you or your child(ren) will not become infected with COVID-19. Further, attending LJT could increase your risk and your child(ren)’s risk of contracting COVID-19.

By signing this agreement, I acknowledge the contagious nature of COVID-19 and voluntarily assume the risk that my child(ren) and I may be exposed to or infected by COVID-19 by attending LJT and that such exposure or infection may result in personal injury, illness, permanent disability, and death. I understand that the risk of becoming exposed to or infected by COVID-19 at LJT may result from the actions, omissions, or negligence of myself and others, including, but not limited to, LJT employees, volunteers, and program participants and their families.

I voluntarily agree to assume all of the foregoing risks and accept sole responsibility for any injury to my child(ren) or myself (including, but not limited to, personal injury, disability, and death), illness, damage, loss, claim, liability, or expense, of any kind, that I or my child(ren) may experience or incur in connection with my child(ren)’s attendance at LJT or participation in LJT programming (“Claims”).

On my behalf, and on behalf of my children, I hereby release, covenant not to sue, discharge, and hold harmless LJT, its employees, agents, and representatives, of and from the Claims, including all liabilities, claims, actions, damages, costs or expenses of any kind arising out of or relating thereto. I understand and agree that this release includes any Claims based on the actions, omissions, or negligence of LJT, its employees, agents, and representatives, whether a COVID-19 infection occurs before, during, or after participation in any LJT program. I give permission to the Program Staff at Liberty Junction Theatre Inc. to arrange any emergency medical care including hospitalization/transportation, if they deem necessary.

I hereby release the Liberty Junction Theatre Inc. from all liability and claims arising in relation to any matter including personal injury or damage to/loss of property, regarding participation in any activity or otherwise and hereby indemnify the Liberty Junction Theatre Inc. from and against such claims, suits, actions and prosecutions by reason of any activity carried out by myself, the enrolled or my child, whether on or off the premises at which the Theatre Arts Programs are held.

LJT Inc. reserves the right to request withdrawal of an actor from the program, at the company's own discretion, where it is judged that the needs of the particular individual cannot be accommodated without unacceptable disruption to the program. Refund will be issued in these cases for days not attended. Please ensure that LJT Inc. is notified well in advance where medical and other related conditions might present an issue with respect to LJT Inc.'s ability to accommodate a particular actor.

I give Liberty Junction Theatre Inc. full permission to photograph, videotape, the enrolled/my child, and to publish said photographs, videotapes, film and or/interviews in Liberty Junction Theatre Inc. publications/printed material, including marketing and promotional materials, social media and on the Liberty Junction Theatre Inc. official website. I release and forever discharge Liberty Junction Theatre Inc. from all actions, causes of actions, claims and demands with respect to any such use except as agreed in writing.

Deposits are non-refundable. If you wish to cancel your registration (if paid in full), requests must be received in writing at least two weeks prior to the first day of the start date. An administration fee of $25 will be charged for each cancellation. After this period, any cancellation requests must be accompanied by a medical certificate in order to receive a refund. You will be refunded for unattended days, less a $25 administration fee.

Liberty Junction Theatre Inc. reserves the right to cancel or re-schedule a camp week or program. 10 days notice will be given and full refund.
